Terms of Service (Content Update/Support Plans & 3rd Party Website Hosting/SSL, Email & Domains)

1. Account Setup

DIGIBEE.NET will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.

2. Content

All services provided by DIGIBEE.NET may only be used for lawful purposes. In addition, restrictions apply. The customer agrees to indemnify and hold harmless DIGIBEE.NET from any claims resulting from the use of our services.

Restricted materials include but are not limited to the following:

  • copyrighted material
  • material we judge to be threatening or obscene
  • adult oriented content
  • hate
  • illegitimate software
  • internet relay chat bots
  • phishing content
  • illegal content

3. Zero Tolerance Spam Policy

DIGIBEE.NET takes a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, phishing and spam. Any user who sends out spam will have their account terminated without notice.

DIGIBEE.NET reserves the right to require changes or disable as necessary any website, account, database, or other component that does not comply with this policy, at its sole discretion. DIGIBEE.NET also reserves the right to make any such modifications in an emergency at our sole discretion.

DIGIBEE.NET reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of DIGIBEE.NET.

4. Payment Information

You agree to supply appropriate payment for the services received from DIGIBEE.NET in advance of the time period during which such services are provided. You agree that until and unless you notify DIGIBEE.NET of your desire to cancel any or all services received, those services will be billed on a recurring basis.

DIGIBEE.NET reserves the right to change the monthly payment amount and any other charges at anytime.

5. Backups and Data Loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on reseller, shared or other hosting accounts be they at Enom, Webnames, THE CLIENT's provide or other hosting account held by DIGIBEE.NET or THE CLIENT, be it at Enom, Gandi SAS/US, Webnamesca, or similar third-party datacentres and mail servers (i.e. in Atlanta, Dallas, Colorado, Vancouver, Kelowna, British Columbia or elsewhere), Enom's, Gandi's, Webnames.ca's or the client's provider's shared accounts, hosting accounts, reseller hosting accounts, servers, mail server and webmail servers, at Enom, Gandi SAS/US, Webnames.ca or at Enom's, Gandi's or Webnames.ca's third-party providers' server, partners servers and such.

6. Cancellation and Refunds

We reserve the right to cancel the account at any time.

Customers may cancel at any time. We give  you an unconditional 30 day money back guarantee on shared hosting. There are no refunds for domain registrations. Refund requests after 30 days will be refunded on a prorated basis of any unused time.

Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

7. Resource Usage

Users are not allowed administrative access to cPanel, Plesk, Webnames.ca, Gandi, Enom or such. Users with Content Management Website may be offered editor level access. Users may not initiate the following and similar:

  • Use weak passwords for their Editor accounts on CMS systems.
  • Link to illegal content.
  • Link to misleading phishing content.
  • Offer illegal or misleading content.
  • Use of 10% or more of system resources for longer then 60 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etcetera
  • Run any type of interactive real-time chat applications that require server resources. Remotely hosted services are allowed.
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Embed chat iframes.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any gaming servers, etc

8. Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the content updates and 3rd party hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

9. Money back Guarantee

Each of DIGIBEE.NET's plans carries a 30 day unconditional money back guarantee. If you are not completely satisfied with our services within the first 30 days of your service, you will be given a full refund of the contract amount.

10. Price Change

We reserve the right to increase our fees for service packages with and without 3rd party hosting, findability and/or content updates. We also reserve the right to change prices listed on our site and the right to change the amount of resources given to plans.

11. Indemnification

Customer agrees that it shall defend, indemnify, save and hold DIGIBEE.NET harmless from any and all demands, liabilities, losses, financial losses, loss of business, insurance claims, litigation costs, any other costs and claims, including reasonable attorney's fees asserted against DIGIBEE.NET, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold or resold by DIGIBEE.NET, its owner, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with DIGIBEE.NET; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) hacking activity; (4) phishing; (5) copyright infringement and (6) any defective or fake products sold to customers from DIGIBEE.NET's websites or any websites under DIGIBEE.NET's care, be it at third-party datacentres, servers, reseller accounts, hosting/mail & other accounts at Enom, Webnames, Gandi, PC Jaguar, their partners, their 3rd party providers or other such servers or accounts (be they in Atlanta, Dallas, Colorado, Vancouver, Kelowna, British Columbia or elsewhere), for example THE CLIENT's own hosting/email & such provider be it Enom, Webnames, Network Solutions, Dream Host or any other. DIGIBEE.NET strongly encourages THE CLIENT to seek out IT, security, legal, trademark and insurance experts to help in making correct decisions, prevent issues, offer required level of security, and take appropriate measures.

12. Disclaimer

DIGIBEE.NET will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. DIGIBEE.NET disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, abuse, no deliveries, wrong delivery, email service disruption, email message loss, and any and all service interruptions caused by us, our employees or any third parties or third party services we may include, bundle, package with our services. DIGIBEE.NET will not be responsible for any damages your business and finances may suffer because of malicious 3rd parties, data theft, related service disruption, phishers and so on. Again, DIGIBEE.NET strongly encourages THE CLIENT to seek out IT, security, legal, trademark, and insurance experts to help in making correct decisions, prevent issues, offer required level of security, and take appropriate measures.

13. Jurisdiction

This Terms of Service shall be governed by the laws of Ontario & Canada which shall claim venue and jurisdiction for any legal action or claim arising from the Terms of Service. The said Terms of Service or part thereof is void where prohibited by law.

14. Survival of Terms of Service

Where one or more terms of the said Terms of Service are held to be void or unenforceable for whatever reason, any other terms of the Terms of Service not so held will remain valid and enforceable at law.

15. Changes to the TOS

DIGIBEE.NET reserves the right to revise its policies at any time. New Terms of Service will be presented on the website as they become available.
